1. Definitions
In these terms and conditions the following terms shall have the following meanings:
- Reflection period : the period within which the consumer can make use of his right of withdrawal.
- Consumer : the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with SpineFlexer.
- Day : calendar day.
- Durable medium : any instrument enabling the consumer or entrepreneur to store information for later consultation and unchanged reproduction.
- Right of withdrawal : the option for the consumer to cancel the distance contract within the cooling-off period.
- Entrepreneur : SpineFlexer, the remote product provider.

Distance contract : a contract for which exclusive use is made of distance communication techniques.

3. Applicability
- These terms and conditions apply to every offer from SpineFlexer and to every distance contract concluded between SpineFlexer and the consumer.
- Before the agreement is concluded, the text of these terms and conditions will be made available to the consumer in a manner that enables easy storage on a durable data carrier.
4. The offer

The offer contains a complete and accurate description of the products offered.
- Obvious mistakes or errors in the offer do not bind SpineFlexer.
- We strive to accurately represent images. Deviations do not entitle you to compensation or cancellation.
5. The agreement
- The agreement is concluded at the moment the consumer accepts the offer and confirms it by SpineFlexer.
- SpineFlexer confirms receipt of the order electronically.
- SpineFlexer takes appropriate measures to secure electronic data transfer.
6. Right of withdrawal
- The consumer can cancel the contract for the purchase of a product within 14 days without giving any reason. The period begins on the day after receipt of the product.
- During the cooling-off period, the consumer must handle the product and packaging with care. Returns must be in their original condition and packaging.
7. Costs in case of revocation
- The costs of return shipping are borne by the consumer.
- Amounts already paid will be refunded within 14 days after return shipment.

8. Exclusion of right of withdrawal
The right of withdrawal is excluded for:
- Products that spoil quickly or have a limited shelf life.
- Products which are not suitable for return for hygiene reasons and of which the seal has been broken.
- Products that cannot be returned due to their nature.
9. The price
- Product prices include VAT and exclude shipping costs, unless otherwise stated.
- Obvious errors in prices do not bind SpineFlexer.
10. Conformity and warranty
- SpineFlexer guarantees that products comply with the agreement and reasonable requirements of soundness.
- Legal warranty and any manufacturer's warranties remain in full force.
11. Delivery and execution
- Delivery will take place at the address specified by the consumer.
- Orders placed before [insert time, e.g. 2:00 PM] are usually shipped the same day and delivered within 2-3 business days.

In exceptional cases, delivery may take up to 30 days. If this happens, you will be notified in a timely manner.
- If the product has been offered as a pre-order, the delivery time is 2 to 4 weeks, unless stated otherwise.
- In case of delay, the consumer has the right to cancel the agreement free of charge and is entitled to a refund.
- The risk of damage or loss lies with SpineFlexer until the moment of delivery to the consumer or a third party designated by the consumer.

12. Payment
- Payment must be made via the offered payment methods, preferably immediately upon ordering.
- In the event of non-payment, SpineFlexer may charge reasonable collection costs.
13. Complaints procedure
- Complaints can be reported via info@spineflexer.nl .
- Complaints will be answered within 7 days. If more time is needed, the consumer will receive an estimated response time.
14. Liability
- SpineFlexer is not liable for indirect damage or damage caused by incorrect use of the product.
- Liability is limited to the purchase price of the product.
15. Disputes
Agreements between SpineFlexer and the consumer are exclusively governed by Dutch law.
16. Changes
SpineFlexer reserves the right to change these terms and conditions. Changes will not apply to existing agreements.
